Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Swip Deals mobile application and website (together, the “Service”), operated by Metrix Cyber Establishment (“Swip Deals”, “we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1.About Swip Deals — our role

Swip Deals is a platform that shows you time-limited deals and offers (“Offers”) made available by independent third-party businesses (“Merchants”). Swip Deals is not the seller or provider of the food, goods, or services described in any Offer. The Merchant is solely responsible for its Offers and for providing the underlying goods or services. Any purchase, consumption, or other transaction arising from an Offer is a contract between you and the Merchant, not with Swip Deals.

We provide the technology that lets you discover Offers near you, claim them, and redeem them at the Merchant. We are not a party to the transaction between you and a Merchant.

2.Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Service. By using Swip Deals you confirm that you meet these requirements and that the information you provide is accurate and belongs to you.

3.Your account

• You sign in with your phone number and a one-time code. Keep your phone number and device secure; you are responsible for activity that happens through your account.
• One account per person. Do not share your account or let others use it.
• Tell us promptly if you believe your account has been used without your permission.
• We may suspend or close an account that is used in breach of these Terms.

4.Claiming and redeeming Offers

• Claiming an Offer reserves it for you, subject to availability, the Offer’s quota, and its expiry time. A claim is not a payment and does not guarantee a Merchant’s stock, opening, or service at the time you arrive.
• You redeem an Offer in person at the Merchant by showing the QR code in the app for the Merchant’s staff to scan.
• Offers are subject to the Merchant’s own terms, availability, and opening hours. Offers have no cash value, cannot be exchanged for cash, and may not be resold or transferred.
• Unless stated otherwise, an Offer may be claimed once per user, and must be redeemed before it expires.
• We may add, change, limit, pause, or remove Offers at any time, and Merchants may do the same with their own Offers.

5.Price and payment

The Swip Deals app is free for users. Any amount payable for the goods or services in an Offer is paid directly to the Merchant according to the Merchant’s pricing at the point of sale, plus any taxes required by law. Swip Deals does not collect payment for Merchant goods or services.

6.Merchants and their Offers

Merchants are solely responsible for their Offers, including the accuracy of descriptions and images, availability and quota, pricing, quality, food safety and hygiene, and honouring valid claims. Questions, complaints, or disputes about an Offer or a Merchant should be raised with the Merchant in the first instance. We are not responsible or liable for a Merchant’s acts or omissions, or for the goods or services they provide. We may, but are not obliged to, help facilitate communication between you and a Merchant.

7.Acceptable use

When using the Service you agree not to:

• use it for any unlawful, fraudulent, or harmful purpose;
• misuse claims (for example, claiming Offers you do not intend to use, or to deny them to others), or resell or commercially exploit Offers or claims;
• access the Service by automated means (scraping, bots), or attempt to probe, reverse-engineer, or interfere with the Service or its security;
• impersonate another person or misrepresent your identity;
• upload content that is unlawful, misleading, defamatory, or infringes others’ rights.

8.Reviews and user content

You may submit reviews and ratings of venues you have visited. Reviews are shown publicly as from a “Verified visitor” — your name and contact details are never displayed with a review. You are responsible for the content you submit, it must be truthful and lawful, and by submitting it you grant us a non-exclusive, royalty-free licence to use, display, and distribute it in connection with the Service. We may remove content that breaches these Terms.

9.Notifications and location

If you turn them on, Swip Deals sends push notifications and location-based “deal nearby” alerts. You can turn these off at any time in the app or your device settings. How we handle location and other personal data is explained in our Privacy Policy.

10.Intellectual property

The Swip Deals name, logo, design, and the content we provide are owned by us or our licensors and are protected by law. We grant you a limited, personal, non-transferable, revocable licence to use the app for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service except as allowed by law.

11.Third-party services

The Service relies on third-party services (for example map providers and the mobile app stores). Your use of those services is governed by their own terms, and we are not responsible for them.

12.Disclaimers

The Service and all Offers are provided “as is” and “as available”. To the extent permitted by law, we do not warrant that the Service will be uninterrupted or error-free, or that any Offer will be available, accurate, or meet your expectations. You use the Service and claim Offers at your own discretion and risk.

13.Limitation of liability

To the maximum extent permitted by the laws of the Kingdom of Saudi Arabia:

• we are not liable for the acts or omissions of Merchants, or for the goods or services provided under any Offer;
• we are not liable for indirect, incidental, special, or consequential losses, or for loss of profit, data, or goodwill arising from your use of the Service;
• nothing in these Terms excludes any liability that cannot be excluded under applicable law.

14.Indemnity

You agree to indemnify and hold harmless Metrix Cyber Establishment against claims, losses, and reasonable expenses arising from your breach of these Terms or your misuse of the Service.

15.Suspension and termination

We may suspend or end your access to the Service if you breach these Terms or use the Service in a way that may cause harm or legal liability. You may stop using the Service at any time and can delete your account and associated data in the app (Profile → Delete account).

16.Changes

We may update the Service and these Terms from time to time. We will post the updated Terms here and change the “Last updated” date; significant changes will be notified in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.

17.Governing law and disputes

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from or relating to the Service or these Terms shall be subject to the jurisdiction of the competent courts in Jeddah, Kingdom of Saudi Arabia.
